The Oregon Department of Agriculture certified, registered, and regulates our industrial hemp pursuant to the Agricultural Act of 2014. 7 U.S.C. § 5940. This federal law defines industrial hemp as, “the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration [Delta-9 THC] of not more than 0.3 percent on a dry weight basis.” 7 U.S.C. § 5940(b)(2).

Wild Flower Hemp on behalf of its licensed industrial hemp growers is operating in compliance with the Agricultural Act of 2014, 7 U.S.C. § 5940 pursuant to state-authorized pilot programs lawfully established and defined under 7 U.S.C. § 5940, subsections (a) and (b)(1), and in conformance with Oregon Revised Statutes (“ORS”), Section 571.300 et seq. The Oregon Department of Agriculture independently certified, registered, and regulates the growth, cultivation, and marketing of industrial hemp in conformance with federal and state laws and regulations, as well as all other applicable departmental and agency rules. ORS § 571.300.
Federal law both permits and also encourages the growth, cultivation, and marketing of industrial hemp products pursuant to the above-cited pilot programs, as well as in other agricultural or academic research programs not applicable to the instant notice. 7 U.S.C. § 5940, “Legitimacy of Industrial Hemp Research;” see also, ORS § 571.300 et seq. Pursuant to law, and the rights and protections established thereby, Wild Flower Hemp offers this legal industrial hemp in the United States.
Industrial hemp is defined as, “the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration [Delta-9 THC] of not more than 0.3 percent on a dry weight basis.” 7 U.S.C. § 5940(b)(2), emphasis added. The industrial hemp flower applicable to this notice and identified in the enclosed Certificate of Analysis has a Delta-9 THC level at or below the 0.3% maximum identified in the code. Therefore, this product is properly defined as industrial hemp, legal to possess and sell by federally compliant and state-certified, registered, and regulated entities. Id. This legal right is applicable to states and federal governments through protections contained in the United States Constitution.
